Gestational Carrier Agreements

The Gestational Carrier Agreement contains all of the terms of an intended parent’s arrangement with a gestational carrier.  The agreement addresses a wide variety of issues including the term of the arrangement, following medical instructions, confidentiality, health and life insurance, abortion and selective reduction, and reimbursements.

Ovum Donation and Sperm Donation Agreements

An Ovum Donation Agreement contains all of the terms of an intended parent’s arrangement with an ovum donor.  The agreement addresses a wide variety of issues including confidentiality, donor’s availability for ovum retrieval, the importance of following medical instructions, and compensation.  We draft and negotiate Ovum Donation Agreements for both known and anonymous ovum donors.

Embryo Donation Agreements

An Embryo Donation agreement contains all of the terms of an intended parent’s arrangement with an embryo donor.  The agreement addresses a number of issues including the number of embryos to be donated, storage fees, legal parentage and financial terms.  The most important purpose of this Agreement is to terminate the embryo donor’s rights to the donated embryos and any child resulting from the donated embryos.

Second Parent/Co-Parent Adoptions

Where a legal parentage order for one or both intended parents is not available, intended parents can often establish their legal parentage through a second parent or co-parent adoption.  We prepare and file second parent adoptions in New York and co-parent adoptions in New Jersey.

Insurance Review

When selecting a gestational carrier, an intended parent is often most concerned with the gestational carrier’s personality, obstetrical history, habits and living situation.  Depending upon the intended parent’s budget, however, another important factor in selecting a gestational carrier is the gestational carrier’s health insurance plan.  We review a gestational carrier’s health insurance for language and exclusions suggesting whether her health insurance carrier will provide coverage for her gestational carrier pregnancy.  Please be aware that most intended parents pay out-of-pocket for fertility medical procedures and medications necessary to achieve pregnancy.

Legal Parentage Orders

One critical criteria for selecting a gestational carrier is an intended parent’s ability to establish legal parentage.  An intended parent’s ability to establish legal parentage is dependent upon a gestational carrier’s state of residence and/or state of delivery.  The laws and practices of the state in which the gestational carrier delivers normally controls how the intended parent will establish legal parentage.  Legal parentage orders can be obtained prior to or after birth, depending upon the state.  We assist intended parents with obtaining legal parentage orders in New Jersey as well as a handful of other states.  

Declarations of Maternity/Paternity

Intended Parents using an uncompensated gestational carrier in the State of New York have the opportunity to establish their legal parentage through a declaration of maternity and paternity.  Let’s discuss whether this is the best option for you.
